Terms of Service

These terms govern your use of the CYKI app and www.canyoukicksit.com, operated by Can You Kicks It ("CYKI", "we"), based in Denmark. By creating an account or using the app, you agree to them.

1. What CYKI is — and is not

2. Your account

You must be at least 16 years old to use CYKI. Keep your sign-in credentials secure — you are responsible for activity on your account. Provide accurate information, and don't impersonate anyone else. You can delete your account at any time in the app (Profile → Account → Delete account).

3. Acceptable use

Don't misuse the service. In particular, don't:

• scrape, harvest, or systematically extract data from the app or the CYKI 100 index;
• reverse engineer, probe, or disrupt the service or its infrastructure;
• upload content that is unlawful, infringing, or abusive, or that contains other people's personal data without their permission;
• use the service for any unlawful purpose.

4. Your content

You own what you put into CYKI — your collection data, journal entries, photos, and receipts. You grant us a limited licence to host, store, and display that content, solely to provide the service to you (and, where you opt in, to show your username, avatar, and game performance on the leaderboard). You are responsible for the content you upload and must have the right to upload it.

5. Our intellectual property

The CYKI app, website, brand, design, and the CYKI 100 index — including its methodology and published values — are our property. You may not republish or redistribute the index or substantial parts of our data without our written permission.

6. Third-party data and trademarks

Market pricing and catalog data come from third-party providers. We don't control and can't guarantee their accuracy or availability. Sneaker names, brand names, and product images are the trademarks and property of their respective owners. CYKI is not affiliated with, endorsed by, or sponsored by Nike, Adidas, StockX, GOAT, or any other brand or marketplace mentioned in the app.

7. The service may change

CYKI is free to download. We may add, change, or remove features, or discontinue the service, at any time. If we discontinue the service entirely we will give you reasonable notice so you can export your data.

8. Games & virtual items

CYKI includes seasonal games, competitions, and leaderboards — for example our "Beat the Market" basket game, run alongside occasional themed events. These are entertainment features, not gambling or a lottery: they are free to play, nothing is wagered, and there are no cash prizes.

Playing may earn you virtual items such as points, badges, trophies, or titles. These have no monetary value, are not transferable to anyone else, and cannot be redeemed or exchanged for cash, goods, or anything outside the app. We may modify, rebalance, or discontinue any game or virtual item at any time, without liability to you.

Game outcomes are computed from the same third-party market data described in Section 1, which can be wrong, incomplete, or delayed. Our computed result for a game is final. A data error or gap that affects an outcome does not create any liability on our part.

We may disqualify entries, reset scores, or suspend accounts we reasonably believe involve cheating, automation, or other abuse of a game.

If we ever run a promotion with real-world prizes, it will be governed by its own separate competition terms, announced at the time. Nothing in these terms entitles you to any prize.

9. Disclaimer and limitation of liability

The service is provided "as is" and "as available", without warranties of any kind, to the extent permitted by law.

To the maximum extent permitted by law, our total aggregate liability to you arising out of or in connection with these terms or your use of the service is limited to the amount you paid us for the service in the 12 months before the event giving rise to the claim. CYKI is currently free to use, so unless you have paid us directly for something, this cap is €0.

To the maximum extent permitted by law, we are not liable for indirect or consequential damages, loss of profit, loss of data, or loss of business opportunity arising from your use of the service — including any decision you make based on market values, the CYKI 100 index, or any other information shown in the app (see Section 1: this is not financial advice, and figures can be wrong or stale).

10. Termination

You can stop using CYKI and delete your account at any time. We may suspend or terminate accounts that violate these terms, after notice where reasonably possible. Sections 5, 6, 8, and 9 survive termination.

11. Governing law

These terms are governed by the laws of Denmark. Disputes are subject to the jurisdiction of the competent Danish courts, without prejudice to any mandatory consumer protections that apply in your country of residence.

12. Changes and contact
